Under Secretary of Defense, John Rood Testified to Congress That the President Already Has Lawful Authority To 'Erect Barriers, Roads, Fencing...to Disrupt Drug Smuggling'
1-30-19, At a hearing of the House Armed Service Committee, Defense Dept official, Under Secretary of Defense John Rood agreed with two Republican lawmakers that President Trump doesn't need to declare a national emergency to get military assistance in building a border barrier. Rep. Vicky Hartzler (R-Mo.) pointed to Title 10, Section 284 of the U.S. Code, that authorizes the Defense Dept to provide support for counter-drug activities, if such help is requested by appropriate federal or state officials.
John Rood was asked: "Has President Trump, to your knowledge, ever used 10 U.S.C. 284 to direct the military to build the wall that is necessary for border security?"
Rood replied: "No, not to my knowledge, Congressman."
Rood was asked: "If President Trump were to direct the Pentagon, the United States military, pursuant to 10 U.S.C. 284 to build such barriers as are necessary to secure our Southern border from drug trafficking and international crime cartels, would the United States military obey that order?"
Rood replied: "If we judge it to be a lawful order, yes, Sir. And I assume it would be."
